Why do we support consumer choice and control over the services individuals receive?



Consumer directed services afford the individual/family greater flexibility and enable the individual/family to:
- Determine the specific services to be provided;
- Decide how the available funding will be spent;
- Make decisions concerning who will provide the services as well as when, where and how the services will be provided; and
- Provide overall direction, guidance and supervision of the services.
Who is eligible for 525 Services?
525 Services are available to any individual who:
- Is eligible and has funding for services pursuant to He-M 503 (Developmental Disabilities) or He-M 522 (Acquired Brain Disorders);
- Wishes to direct his or her services;
- Wishes to design the services;
- Wishes to select the service providers; and
- Wishes to decide how the authorized funding is to be spent.
- And does not receive services under He-M 524.
What sort of provider options are available under 525 Services?
There are four basic models of service provision, but when blended together or arranged
in combination with one another within the same program design, there can be many
different ways to set up this service.
The four basic models are:

Model #1: Vendor Agency as Service Provider


1. The vendor agency is responsible for employing staff, assuring certification,


complying with all regulations, and managing the day-to-day delivery of services.


2. The individual/family determines the specific services and provides oversight,


participates in the hiring, training and supervision of staff; and reviews


documentation prepared by the vendor agency.


3. Region 10 contracts with the individual/family and vendor agency for the

Model #2: Region 10 or Another Agency acts as Fiscal Intermediary


1. Region 10 or another agency becomes the employer of record (EOR) for the


person(s) providing the actual services and is expected to assure compliance with


2. The individual/family assumes responsibility for assuring the certification of


services, compliance with regulations and managing the day-to-day delivery of


3. Region 10 contracts with the individual/family and involved agency for the

Model #3: Individual/Family as Employer of the Service Provider.


1. The Individual/family establishes themselves as an employer.


2. The individual/family assures compliance with all state and federal employment


regulations as well as compliance with all state standards and area agency


expectations related to services and certifications. The individual/family also


manages the day-to-day delivery of services.


3. The individual/family recruits, hires, trains, and supervises their own staff.


4. Region 10 contracts with the employer as an independent subcontractor for


the agreed upon services.

Model #4: Family member as Provider of Direct Services.


1. The family member becomes the provider of direct service either as an


employee or independent contractor.


2. As an employee or independent contractor, the family member becomes


responsible for compliance with all state laws and regulations as well as area


agency expectations related to services and certifications.


3. Region 10 contracts with the family member as an independent contractor to


provide the agreed upon services for which the family member (as service


provider) will be compensated.
